Ok good. Plug the sd card into the system and see if you have the themes & splashes folder on the root of the sdcard, and the Anemone folder inside the 3ds folder. If so, copy/paste them to your pc somewhere, and delete them from the sdcard. Plug it back and boot the system.
Turns out it was because my 3DS was fresh (newly formatted and setup, with custom firmware). Changing the theme to any other theme (e.g. Red, Blue, Yellow, Pink, or Black theme) from the default theme, created 'Theme Management Information' on my 3DS. A first time loading sort-of-thing.
